Live team map awareness

1001733394 ONTARIO INC. o/a VisAware

TERMS OF SERVICE

Effective date: September 21, 2026

Last updated: September 21, 2026

These Terms of Service (“Terms”) are a contract between you and 1001733394 ONTARIO INC. o/a VisAware (“VisAware,” “we,” “us”) for the VisAware websites, mobile applications, maps, messaging, and related services (the “Service”). VisAware is the product name.

By creating an account, clicking “I agree,” or using the Service, you accept these Terms. If you use the Service for a city, company, or other organization, you confirm you can bind that organization.

1. What VisAware is

VisAware is a team-awareness and field-operations tool. It may show live or delayed locations, user-created Alerts and Points of Interest, Planned Routes, and messages.

2. What VisAware is not

VISAWARE IS NOT A REPLACEMENT FOR 9-1-1, POLICE, FIRE, AMBULANCE, PUBLIC-SAFETY RADIO, OR ANY OFFICIAL DISPATCH / CAD SYSTEM.

If anyone is in danger or needs emergency help, call 9-1-1 or use official channels immediately. Do not rely on VisAware as the only way to request backup, report a crime, or protect life or property.

3. No guarantee of safety or response

The Service is informational only. We do not guarantee that any location, Alert, message, planned route stop, or map display is accurate, complete, timely, or seen by anyone in time to prevent harm. VisAware is not a policing authority, employer, or emergency service.

4. Accounts and groups

You must be 18+. Keep credentials confidential. The group creator (Team Leader) is responsible for seats, invite codes, and fees. Invite codes are confidential. Do not share them publicly.

5. Location, GPS, and devices

The Service may collect and share device location when you enable it or when your organization requires sharing while on duty. GPS and networks fail. Locations can be wrong or missing because of buildings, tunnels, battery savers, denied permissions, spoofing, delays, or outages. Proximity alerts may not fire. Visibility toggles and background location depend on Apple/Google permissions you control. You and your organization are responsible for on-duty safety procedures and backup communications.

6. Alerts, POIs, planned routes, and chat

Alerts and POIs are user-generated and unverified. A post is not confirmation that an incident happened or that any agency was notified. Planned routes and check-ins are planning aids, not proof of exact presence. Chat is not dispatch. Do not post false, defamatory, or unlawfully identifying information.

7. Maps

Maps may use third-party or open data (including OpenStreetMap). Data can be outdated. Follow traffic laws and your agency’s procedures.

8. Acceptable use

No unauthorized tracking, stalking, harassment, impersonation, hacking, scraping, resale of location data, or unlawful surveillance. We may suspend accounts.

9. Organizational customers

If an organization gives you access, that organization must obtain any legally required notices or consents for employee/officer location monitoring and must set lawful policies. Workplace disputes are between you and that organization.

10. Fees and trial

Paid plans and the 14-day trial are described at signup and on visaware.app. The Team Leader (group creator) chooses a plan and is responsible for fees. Subscriptions are billed in CAD through Stripe Checkout on visaware.app. Starting a trial requires a payment method, which Stripe collects. Checkout applies 15% off the first 3 months on a monthly plan. On a yearly plan, the first year is 15% off, then full price. After the trial, the saved payment method is billed on the first bill date unless the group creator cancels the subscription first in the Stripe Customer Portal (Billing → Manage subscription on visaware.app). If you cancel or a bill goes unpaid, we keep your map and app data for 14 days. That 14-day data-retention window is separate from the 14-day trial. When a trial ends unpaid, a bill fails, or the subscription is canceled, we may limit or suspend the workspace. Fees are generally non-refundable except as required by law. Billing questions: support@visaware.app.

iOS App Store and Google Play builds are sign-in clients. They do not use in-app purchase. Subscriptions are sold only on the website.

11. Privacy

Personal information, including location and billing details processed by Stripe, is handled under our Privacy Policy.

12. Intellectual property

The Service, VisAware name, and logos belong to 1001733394 ONTARIO INC. o/a VisAware or its licensors. You get a limited right to use the Service only.

13. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

To the maximum extent permitted by law, 1001733394 ONTARIO INC. o/a VisAware disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted service or that the app will prevent injury, missed response, or data loss.

14. Limitation of liability

To the maximum extent permitted by law, 1001733394 ONTARIO INC. o/a VisAware and its directors, officers, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.

Total liability for all claims is limited to the greater of (a) amounts you paid 1001733394 ONTARIO INC. o/a VisAware in the 12 months before the claim or (b) CAD $100 if you were on a free trial.

These limits do not apply to liability that Ontario or federal law does not allow to be limited.

15. Indemnity

You will indemnify 1001733394 ONTARIO INC. o/a VisAware against claims arising from your use of the Service, your content, unauthorized tracking, or your organization’s deployment of VisAware, except to the extent caused by our proven willful misconduct.

16. Termination

You may stop using the Service at any time. We may suspend or end access for breach, legal risk, or non-payment. Sections that should survive (including 2, 13–15, 17) survive.

17. Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there. Courts in Ontario have jurisdiction, except for rights that cannot be waived.

18. Changes

We may update these Terms. Continued use after notice is acceptance.
